Pagia Copyright And Intellectual Property Policy

Version 1.0

Effective Date: July 12, 2026

Last Updated: July 12, 2026

1. Introduction

1.1 Purpose of this Policy

Pagia exists to empower creators.

Our Platform is built on the principle that authors, publishers, illustrators, editors, translators, narrators, researchers, filmmakers, educators, artists, designers, literary agents, production studios, and other creative professionals should be able to create, publish, distribute, license, adapt, and commercialize their intellectual property with confidence.

The protection of copyright and other intellectual property rights is therefore fundamental to the operation of the Platform.

This Copyright and Intellectual Property Policy explains how Pagia protects copyrighted works, respects the rights of creators, responds to allegations of infringement, manages intellectual property disputes, and supports the lawful creation and distribution of creative works through its publishing and marketplace ecosystem.

This Policy forms part of Pagia's broader legal framework and should be read together with the Terms of Service, Platform Participation Agreement, Privacy Policy, Community Guidelines, AI Usage Policy, Licensing Policies, and any other agreements governing the use of the Platform.

1.2 Scope

This Policy applies to every person or organization using Pagia, including but not limited to authors, readers, publishers, bookstores, editors, illustrators, designers, translators, narrators, educators, literary agents, researchers, production studios, rights holders, rights buyers, developers, marketplace participants, API users, business partners, and any other person who uploads, publishes, licenses, distributes, accesses, purchases, adapts, or otherwise interacts with content on the Platform.

The Policy applies to all forms of intellectual property made available through Pagia, including literary works, manuscripts, ebooks, print books, articles, essays, educational materials, poetry, scripts, screenplays, illustrations, photographs, artwork, cover designs, audio recordings, audiobooks, video content, animations, translations, metadata, promotional materials, databases, software, and other creative works protected by applicable intellectual property laws.

1.3 Our Intellectual Property Philosophy

Pagia recognizes that creative works often represent years of research, artistic effort, financial investment, cultural heritage, and personal expression.

We believe creators should retain meaningful control over their intellectual property while benefiting from technology that enables broader discovery, lawful distribution, commercial opportunity, and international collaboration.

Accordingly, Pagia seeks to balance the interests of creators, readers, publishers, educational institutions, production companies, technology providers, and other participants through policies that encourage creativity while respecting copyright law and legitimate intellectual property rights.

Pagia does not claim ownership of User Content merely because it is uploaded, published, processed, stored, distributed, or otherwise made available through the Platform.

Instead, Pagia seeks to provide the infrastructure through which creators may exercise, commercialize, license, and protect their rights.

2. Ownership of Intellectual Property

2.1 Ownership Remains with the Creator

Except as expressly provided in a separate written agreement, all intellectual property rights in content uploaded, created, published, licensed, or otherwise made available through the Platform remain vested in the person or entity that lawfully owns those rights.

Uploading a manuscript, publishing an ebook, creating a bookstore, licensing a work, using artificial intelligence tools, participating in community activities, or otherwise making content available through Pagia does not transfer ownership of copyright or any other intellectual property rights to Pagia.

Authors retain ownership of their literary works.

Publishers retain ownership of materials they lawfully own.

Illustrators retain ownership of their original illustrations.

Designers retain ownership of original creative assets they produce.

Production studios retain ownership of works they lawfully create or acquire.

Rights holders retain ownership of rights lawfully vested in them.

Nothing contained in this Policy shall be interpreted as transferring ownership of intellectual property from its lawful owner to Pagia solely by reason of use of the Platform.

2.2 Platform Intellectual Property

While Users retain ownership of their own content, Pagia owns and retains all intellectual property rights relating to the Platform itself.

This includes, without limitation, the Platform's software, source code, databases, application architecture, algorithms, artificial intelligence systems developed by or for Pagia, APIs, visual interface, user interface design, branding, logos, trademarks, service marks, graphics, proprietary workflows, documentation, business processes, website design, mobile applications, infrastructure, and other proprietary technologies.

Except as expressly permitted by applicable law or authorized in writing by Pagia, no person may reproduce, reverse engineer, modify, distribute, commercially exploit, or create derivative works from the Platform or its proprietary technology.

2.3 Moral Rights

Where recognized under applicable law, Pagia acknowledges and respects the moral rights of creators, including the right to be identified as the author of a work, the right to object to derogatory treatment of a work, and other non-transferable rights afforded under applicable copyright legislation.

Nothing in this Policy shall be interpreted as requiring a creator to waive moral rights except where such waiver is expressly permitted by law and agreed to in writing.

3. User Representations and Warranties

Every User who uploads, publishes, distributes, licenses, sells, adapts, or otherwise makes content available through Pagia represents and warrants that:

They own the relevant intellectual property rights or possess all licenses, permissions, assignments, authorizations, or other legal rights necessary to make the content available through the Platform.

The publication, distribution, licensing, sale, adaptation, or commercialization of the content does not infringe the copyright, trademark, patent, trade secret, moral rights, privacy rights, publicity rights, contractual rights, or any other legal rights of another person or entity.

The content does not knowingly contain material obtained through plagiarism, unauthorized copying, unlawful reproduction, or other forms of intellectual property infringement.

Any third-party material incorporated into the content has been lawfully licensed, authorized, falls within an applicable statutory exception or limitation to copyright, or is otherwise lawfully included.

Where the User acts on behalf of another individual, publisher, organization, estate, literary agency, or rights holder, the User possesses authority to act on behalf of that party.

Users further acknowledge that they remain solely responsible for ensuring that content uploaded to the Platform complies with applicable copyright laws and contractual obligations.

Pagia may rely upon these representations when operating the Platform but reserves the right to request additional information or evidence where ownership or authorization is reasonably questioned.

4. Copyright Registration and Evidence of Ownership

4.1 Proof of Ownership

Although copyright protection generally arises automatically upon the creation of an original work under applicable copyright laws, Pagia may request reasonable evidence of ownership or authorization where necessary to resolve disputes, investigate infringement claims, verify publishing rights, process licensing transactions, comply with legal obligations, or protect the integrity of the Platform.

Evidence of ownership may include copyright registration certificates, publishing agreements, assignment agreements, licensing agreements, author declarations, dated manuscript records, ISBN registration information, contracts with contributors, estate documentation, business records, or other materials reasonably demonstrating ownership or authority.

The absence of formal copyright registration shall not, by itself, be interpreted as evidence that copyright does not exist where applicable law recognizes copyright upon creation.

4.2 Verification Procedures

Pagia may establish verification procedures for authors, publishers, literary agencies, production companies, educational institutions, and other rights holders to improve trust within the Platform.

Verification may include identity verification, business verification, review of publishing history, confirmation of ownership documentation, verification of ISBN records, confirmation of licensing authority, or other reasonable measures designed to reduce fraud and improve marketplace confidence.

Successful verification does not constitute a legal determination of copyright ownership and does not prevent future disputes from being investigated where new evidence becomes available.

4.3 Copyright Metadata

To improve discoverability, rights management, licensing opportunities, and attribution, Pagia may associate published works with copyright metadata supplied by Users.

Such metadata may include the name of the author, publisher, copyright holder, publication date, ISBN, edition information, licensing terms, territorial rights, language information, adaptation availability, translation rights, and other rights-management information.

Users are responsible for ensuring that copyright metadata submitted to the Platform is accurate, complete, and kept reasonably up to date.

Pagia reserves the right to correct obvious technical errors, request clarification where inconsistencies are identified, or temporarily restrict publication where materially inaccurate rights information could mislead Users or create legal risk.

5. Permitted Uses of Content

5.1 Lawful Access to Content

Content made available through Pagia may be accessed, purchased, downloaded, streamed, licensed, or otherwise used only in accordance with the rights granted by the applicable rights holder, the terms governing the relevant transaction, this Policy, the Terms of Service, and applicable law.

Except where expressly authorized by the copyright owner or otherwise permitted by law, Users acquire only the limited rights expressly granted through the Platform. The purchase or lawful acquisition of an ebook, audiobook, digital publication, educational resource, or other creative work does not transfer ownership of the underlying copyright or any other intellectual property rights.

Users shall respect all copyright notices, licensing conditions, attribution requirements, technological protection measures, and other restrictions applicable to the relevant content.

5.2 Personal Use

Unless otherwise stated by the applicable license or rights holder, content obtained through Pagia may be used solely for the personal, non-transferable, and lawful purposes for which access was granted.

Personal use may include reading purchased ebooks, accessing educational materials, listening to lawfully acquired audiobooks, viewing licensed content, and utilizing purchased resources within the limits established by the applicable license.

Users shall not permit unauthorized third parties to access content through their accounts or otherwise circumvent restrictions governing lawful access.

5.3 Commercial Use

No User may reproduce, distribute, publish, sell, sublicense, publicly perform, publicly display, commercially exploit, adapt, translate, or otherwise use another person's copyrighted work for commercial purposes without obtaining all necessary rights, permissions, licenses, or authorizations from the relevant rights holder.

Where Pagia provides marketplace infrastructure for licensing or commercial transactions, such activities shall be governed by the applicable agreements between the relevant parties and any additional Platform policies.

Commercial rights remain with the applicable rights holder unless expressly transferred or licensed through a legally valid agreement.

5.4 Educational and Research Use

Pagia recognizes the importance of education, scholarship, criticism, research, commentary, and other socially valuable uses of creative works.

Nothing in this Policy is intended to limit lawful uses recognized under applicable copyright legislation, including statutory exceptions and limitations such as fair dealing, fair use, quotation, criticism, review, news reporting, teaching, research, library preservation, accessibility accommodations, or similar legally recognized exceptions.

Users remain responsible for ensuring that reliance upon any statutory exception is lawful within the applicable jurisdiction.

5.5 Prohibited Uses

Except where expressly authorized by the rights holder or permitted under applicable law, Users shall not:

Reproduce copyrighted works without authorization.

Upload or distribute pirated books or other infringing materials.

Remove, alter, or conceal copyright notices, attribution information, digital watermarks, metadata, or rights management information.

Circumvent technological protection measures or digital rights management systems.

Knowingly facilitate unauthorized copying, downloading, sharing, or redistribution of copyrighted content.

Create counterfeit editions of published works.

Misrepresent ownership of another person's intellectual property.

Submit plagiarized manuscripts or substantially copied works for publication.

Use automated systems to harvest copyrighted content from the Platform without authorization.

Encourage, assist, or facilitate copyright infringement by others.

These prohibitions apply regardless of whether the infringement occurs directly or indirectly through the use of third-party technologies or services.

6. Copyright Infringement

6.1 Respect for Intellectual Property Rights

Pagia maintains a zero-tolerance approach toward deliberate copyright infringement and other forms of intellectual property abuse.

Users must not upload, publish, distribute, license, advertise, sell, reproduce, or otherwise make available through the Platform any content that infringes the copyright or other intellectual property rights of another person or entity.

This prohibition applies to literary works, manuscripts, ebooks, print books, illustrations, photographs, cover artwork, translations, audiobooks, educational materials, software, databases, video content, screenplays, marketing materials, metadata, and all other forms of protected creative expression.

6.2 Examples of Infringing Conduct

Without limitation, the following conduct may constitute copyright infringement under this Policy:

Publishing a manuscript copied from another author without authorization.

Uploading pirated ebooks.

Selling unauthorized digital copies of commercially published books.

Publishing another person's work under a different name.

Copying substantial portions of another author's work without permission or lawful justification.

Uploading unauthorized translations.

Publishing copyrighted cover artwork without authorization.

Creating unauthorized audiobook versions of copyrighted works.

Offering copyrighted content for download without appropriate rights.

Removing attribution from copyrighted material.

Uploading content generated through plagiarism or unlawful copying.

Submitting AI-generated content that substantially reproduces protected expression from copyrighted works without authorization.

These examples are illustrative only and do not limit other conduct that may constitute infringement under applicable law.

6.3 Platform Response

Where Pagia reasonably believes that content may infringe copyright or other intellectual property rights, the Platform may, without prior notice where appropriate:

Temporarily disable access to the content.

Restrict distribution of the work.

Suspend publication.

Limit marketplace visibility.

Request additional ownership documentation.

Temporarily suspend relevant accounts.

Remove allegedly infringing material.

Freeze related commercial transactions where necessary to preserve evidence.

Commence an internal investigation.

Refer matters to competent legal authorities where appropriate.

Such actions may be taken before the final resolution of a dispute where reasonably necessary to protect rights holders, preserve evidence, maintain Platform integrity, or comply with legal obligations.

6.4 Good Faith Enforcement

Pagia seeks to balance the protection of intellectual property with the rights of Users to publish lawful content.

Accordingly, allegations of copyright infringement will be assessed in good faith based upon the information available at the time. The temporary restriction or removal of content during an investigation does not constitute a legal determination that infringement has occurred.

Similarly, the restoration of content following an investigation does not constitute a judicial determination of ownership or non-infringement.

Where appropriate, Pagia may invite the parties to provide additional documentation, licensing agreements, copyright registrations, contractual records, or other evidence to assist in resolving the matter.

6.5 Cooperation with Rights Holders

Pagia is committed to working constructively with authors, publishers, literary agents, collecting societies, educational institutions, production companies, copyright organizations, and other legitimate rights holders to protect intellectual property and reduce unauthorized exploitation of creative works.

Where appropriate, Pagia may establish trusted rights-holder programs, content verification initiatives, rights management tools, automated detection technologies, or other measures designed to improve copyright protection while respecting the legitimate interests of Users.

Nothing in this Policy obligates Pagia to proactively monitor every item of User Content; however, Pagia reserves the right to do so where reasonably necessary to protect the Platform, comply with legal obligations, or investigate credible reports of infringement.

7. Notice and Takedown Procedure

7.1 Reporting Copyright Infringement

Pagia respects the intellectual property rights of creators and expects every User to do the same.

A copyright owner, an authorized representative of a copyright owner, a publisher, a literary agent, a collecting society, or any other person with lawful authority to act on behalf of a rights holder may submit a notice alleging that material available through the Platform infringes copyright.

Copyright complaints should be submitted only where the complainant has a good-faith belief that the challenged use is unauthorized and infringes applicable copyright law.

Knowingly submitting false, misleading, fraudulent, or bad-faith infringement notices may result in rejection of the complaint, suspension of Platform privileges, termination of accounts, legal liability, or other appropriate action.

7.2 Required Information

To enable Pagia to investigate a copyright complaint efficiently and fairly, an infringement notice should include sufficient information to identify both the complainant and the allegedly infringing material.

Where reasonably possible, a notice should include:

The full legal name and contact information of the complainant.

The name of the copyright owner, if different from the complainant.

A description of the copyrighted work claimed to have been infringed.

Where available, copyright registration details, ISBN information, publishing information, licensing records, contracts, or other evidence supporting ownership or authority.

A description of the allegedly infringing material.

The location of the allegedly infringing material on the Platform, including URLs, publication identifiers, book titles, author names, listing identifiers, or other information reasonably sufficient to identify the content.

A statement explaining why the complainant believes the use is unauthorized.

A declaration that the information provided is accurate and that the complainant is authorized to act on behalf of the copyright owner.

Any additional documentation reasonably necessary to support the complaint.

Pagia reserves the right to request supplementary information before taking action where the initial submission is incomplete or insufficient to permit a meaningful investigation.

7.3 Review of Notices

Upon receiving a copyright complaint, Pagia may conduct an initial review to determine whether the notice appears sufficiently complete and credible to justify further investigation.

During this review, Pagia may request additional information from the complainant, seek clarification from the User who uploaded the content, review available ownership records, compare publication history, examine licensing information, consult internal metadata, or undertake any other reasonable investigative measures.

The submission of a notice does not automatically require immediate removal of content. Pagia may decline to act where a notice is incomplete, unsupported, clearly abusive, or otherwise insufficient to establish a reasonable basis for investigation.

7.4 Interim Protective Measures

Where Pagia reasonably believes that immediate action is appropriate to prevent ongoing harm, preserve evidence, protect rights holders, or comply with legal obligations, the Platform may implement temporary protective measures while an investigation is pending.

Such measures may include restricting public access to the content, suspending sales, pausing royalty distributions relating to the disputed work, disabling downloads, limiting search visibility, freezing licensing activities, or temporarily suspending affected accounts.

These measures are precautionary in nature and do not constitute a legal determination that infringement has occurred.

7.5 Resolution of Complaints

Following completion of an investigation, Pagia may determine that the complaint should be upheld, rejected, resolved through additional documentation, or referred to the parties for independent legal resolution.

Where appropriate, Pagia may permanently remove infringing material, restore previously restricted content, issue warnings, suspend or terminate accounts, retain records for evidentiary purposes, notify affected parties, or implement any other reasonable corrective measures consistent with this Policy and applicable law.

Pagia's decision relates solely to the operation of the Platform and does not constitute a judicial determination regarding copyright ownership or infringement.

8. Counter-Notification Procedure

8.1 Right to Respond

Pagia recognizes that copyright complaints may occasionally be submitted in error, involve mistaken identity, rely upon incomplete information, or concern lawful uses of copyrighted material.

Accordingly, Users whose content has been restricted or removed may submit a counter-notification requesting reconsideration of the action taken.

Counter-notifications should be submitted only where the User has a good-faith belief that the challenged material was removed or restricted as a result of mistake, misidentification, lawful authorization, ownership, licensing, statutory exception, or other legally recognized justification.

8.2 Information Required

A counter-notification should include sufficient information to enable Pagia to evaluate the User's position.

Where reasonably possible, the submission should include:

The User's full legal name and contact information.

Identification of the material that was removed or restricted.

The location where the material previously appeared.

An explanation of why the User believes the material was removed in error.

Any relevant ownership documentation, publishing agreements, assignment agreements, licensing records, copyright registrations, permissions, contracts, or other evidence supporting the User's position.

A declaration that the information provided is accurate and submitted in good faith.

Pagia may request additional documentation where necessary to complete its review.

8.3 Review of Counter-Notifications

Upon receiving a counter-notification, Pagia may review the additional information submitted by the affected User together with the original complaint, internal records, Platform metadata, transaction history, publication history, licensing information, and any other relevant evidence.

Where appropriate, Pagia may provide relevant portions of the counter-notification to the original complainant for the purpose of facilitating resolution of the dispute.

Pagia may encourage the parties to resolve disputes directly where the disagreement primarily concerns contractual rights, licensing arrangements, co-authorship, publishing agreements, succession, or other matters better resolved between the parties or through competent legal proceedings.

8.4 Restoration of Content

Where Pagia concludes that content was removed or restricted in error, or where sufficient evidence supports restoration, the Platform may reinstate access to the material, restore marketplace visibility, resume transactions, or otherwise reverse temporary enforcement actions.

Restoration of content does not constitute a legal determination regarding copyright ownership and does not prevent future complaints supported by new or additional evidence.

Where a dispute cannot reasonably be resolved through the information available to Pagia, the Platform may decline to restore or permanently remove the content pending resolution by the parties or a competent legal authority.

8.5 Good-Faith Participation

Both complainants and responding Users are expected to participate honestly, accurately, and in good faith throughout the copyright review process.

The submission of knowingly false statements, forged documentation, fraudulent ownership claims, fabricated licenses, or intentionally misleading information may result in account suspension, termination of Platform privileges, referral to appropriate authorities, legal action where warranted, or other remedies available under applicable law.

Pagia reserves the right to preserve all records relating to copyright disputes for evidentiary, legal, regulatory, audit, and security purposes.

9. Repeat Infringer Policy

9.1 Commitment to Protecting Intellectual Property

Pagia is committed to fostering a publishing ecosystem built upon respect for intellectual property rights. Users who repeatedly infringe the copyrights or other intellectual property rights of others undermine the integrity of the Platform and the trust placed in it by creators.

Accordingly, Pagia reserves the right to take progressively stronger enforcement action against Users who repeatedly engage in copyright infringement or demonstrate a pattern of intellectual property abuse.

9.2 Determination of Repeat Infringement

In determining whether a User is a repeat infringer, Pagia may consider all relevant circumstances, including:

The number of credible copyright complaints received against the User.

The outcome of previous copyright investigations.

Whether previous complaints were substantiated.

The seriousness of the infringement.

Whether the conduct appears deliberate, reckless, negligent, or accidental.

The User's cooperation during investigations.

Whether the User has taken reasonable steps to prevent future infringements.

Whether fraudulent ownership claims or falsified documentation were submitted.

Pagia is not required to apply a fixed numerical threshold before determining that a User is a repeat infringer.

Each matter shall be assessed individually based upon its particular facts and circumstances.

9.3 Enforcement Measures

Where Pagia determines that a User has repeatedly infringed the intellectual property rights of others, the Platform may, depending upon the circumstances:

Issue formal warnings.

Require completion of copyright compliance education.

Temporarily suspend publishing privileges.

Restrict marketplace participation.

Disable monetization features.

Suspend royalty payments relating to disputed works.

Remove infringing publications.

Restrict access to AI publishing tools.

Suspend or terminate the User's account.

Restrict future account creation.

Report unlawful activity to competent authorities where required by law.

Nothing in this section limits Pagia's ability to take immediate action in particularly serious cases of infringement.

10. Copyright Disputes Between Users

10.1 Platform Neutrality

Pagia provides infrastructure that enables creators, publishers, readers, and rights holders to interact.

Except where required by law or necessary to enforce this Policy, Pagia does not act as a court of law and does not determine ultimate ownership of disputed copyrights or other intellectual property rights.

Where disputes arise between Users, Pagia's role is generally limited to administering Platform policies, preserving evidence where appropriate, implementing temporary protective measures where necessary, and facilitating communication where appropriate.

10.2 Good Faith Resolution

Where a dispute concerns ownership, authorship, licensing, contractual interpretation, royalty entitlement, co-authorship, translation rights, adaptation rights, succession, publishing agreements, or similar matters, Pagia encourages the affected parties to attempt good-faith resolution before pursuing formal legal proceedings.

Where appropriate, Pagia may facilitate communication between the parties for the sole purpose of assisting lawful resolution.

Any such facilitation does not constitute legal advice, mediation services, arbitration, or a determination of legal rights.

10.3 Preservation of Evidence

Where Pagia becomes aware of a bona fide intellectual property dispute, the Platform may preserve relevant account records, publication history, metadata, transaction records, communications, version history, timestamps, licensing records, ISBN records, blockchain transaction records where applicable, and other information reasonably necessary to protect the integrity of future legal proceedings.

Preservation of evidence shall not be interpreted as support for either party's legal position.

10.4 Court Orders and Legal Determinations

Where Pagia receives a final order, judgment, injunction, or other legally binding direction from a court or competent authority relating to ownership, infringement, licensing, publication, removal, or distribution of content, Pagia may implement such order to the extent required by applicable law.

Nothing in this Policy prevents Pagia from complying with lawful judicial or regulatory requirements.

11. Artificial Intelligence and Copyright

11.1 AI-Assisted Creation

Pagia may provide artificial intelligence tools designed to assist Users with activities including writing, editing, proofreading, translation, cover design, metadata generation, screenplay development, educational transformation, audiobook preparation, and other creative workflows.

These tools are intended to assist creators rather than replace independent human creativity.

The availability of AI-powered features does not alter the ownership of User Content except where expressly agreed in writing.

11.2 Responsibility for AI-Generated Content

Users remain solely responsible for all content they create, publish, distribute, license, or otherwise make available through the Platform, regardless of whether artificial intelligence tools were used during the creative process.

Before publishing AI-assisted content, Users are responsible for reviewing the material to ensure that it:

Does not infringe the copyright or other intellectual property rights of third parties.

Does not contain plagiarized material.

Does not violate contractual obligations.

Does not misappropriate confidential information.

Complies with applicable laws and Platform policies.

The use of AI tools shall not excuse copyright infringement or other unlawful conduct.

11.3 Ownership of AI-Assisted Works

Except where otherwise provided by applicable law or a separate written agreement, Pagia does not claim ownership of creative works solely because AI-powered tools were used in their creation.

Ownership of AI-assisted works shall remain subject to applicable copyright law, contractual arrangements, and the extent of original human creative contribution.

Users are responsible for understanding the legal requirements governing copyright protection in their respective jurisdictions.

11.4 AI Training

Pagia respects the confidentiality and commercial value of unpublished creative works.

Unless expressly authorized by the User through an affirmative opt-in mechanism or a separate written agreement, unpublished manuscripts, confidential drafts, private creative materials, and non-public intellectual property submitted to Pagia shall not be used to train Pagia's proprietary artificial intelligence models.

Where Pagia utilizes third-party AI service providers, appropriate contractual safeguards shall be implemented to protect confidential creative works consistent with applicable law and the Privacy Policy.

11.5 Transparency

Where AI-generated or AI-assisted content is required by applicable law or Platform policy to be identified or disclosed, Users shall comply with the applicable disclosure requirements.

Pagia reserves the right to introduce labeling mechanisms, transparency requirements, authenticity indicators, provenance metadata, or similar measures to improve trust within the Platform.

12. Film, Television, Audiovisual and Derivative Rights

12.1 Creator Ownership

Unless expressly transferred or licensed through a separate written agreement, the publication of a literary work on Pagia does not transfer film rights, television rights, streaming rights, adaptation rights, merchandising rights, dramatic rights, gaming rights, translation rights, audiobook rights, podcast rights, stage rights, or any other derivative rights.

Authors and other rights holders retain ownership of these rights unless they choose to license or assign them.

12.2 Rights Marketplace

Where Pagia provides a marketplace through which literary works may be licensed for film, television, animation, gaming, educational use, translation, audiobook production, stage adaptation, or other derivative uses, all transactions shall remain subject to separate licensing agreements negotiated between the relevant parties.

Pagia's role is to facilitate lawful discovery, negotiation, contracting, and commercialization of rights.

Unless expressly stated otherwise, Pagia is not a party to licensing agreements entered into between Users.

12.3 Screenplay Generation Tools

Where the Platform provides tools enabling Users to transform novels, short stories, educational materials, or other literary works into screenplay formats or other derivative creative formats, such tools operate solely for the benefit of the lawful rights holder or a person authorized by the rights holder.

Users shall not use screenplay generation tools to create unauthorized adaptations of works owned by third parties.

12.4 Adaptation Requests

Production studios, filmmakers, streaming platforms, educational institutions, game developers, broadcasters, publishers, and other organizations seeking to adapt works available through Pagia must obtain all necessary rights from the relevant rights holders before exploiting those works commercially.

Pagia may facilitate introductions, negotiations, rights discovery, licensing workflows, contract management, and payment processing but does not guarantee the availability of rights or the successful completion of any transaction.

12.5 Protection of Derivative Rights

Pagia reserves the right to remove listings, suspend negotiations, restrict licensing activities, or take other appropriate action where it reasonably believes that a User is offering rights they do not own or otherwise lacks authority to license.

Users remain solely responsible for ensuring that any derivative rights offered through the Platform are lawfully owned or controlled.

13. Licensing Through Pagia

13.1 Rights Licensing Infrastructure

Pagia may provide technology and marketplace infrastructure through which authors, publishers, literary agents, estates, educational institutions, production companies, translation agencies, audiobook producers, bookstores, and other rights holders may license intellectual property to third parties.

The Platform is intended to facilitate lawful licensing while preserving creator ownership.

Unless expressly stated in a separate written agreement, Pagia does not acquire ownership of intellectual property offered through the licensing marketplace.

13.2 Licensing Authority

Users offering intellectual property for licensing represent and warrant that they possess the legal authority to grant the rights being offered.

Where licensing authority is shared among multiple parties, each User is responsible for ensuring that all necessary approvals, permissions, assignments, or contractual authorizations have been obtained before offering rights through the Platform.

Pagia may request documentation reasonably necessary to verify licensing authority before enabling certain licensing activities.

13.3 Licensing Agreements

Rights licensed through the Platform shall be governed by the applicable licensing agreement entered into between the relevant parties.

Depending upon the nature of the transaction, licensing agreements may relate to publishing rights, translation rights, audiobook production, educational licensing, film adaptation, television adaptation, animation, gaming, merchandising, serialization, anthology inclusion, territorial distribution, or other authorized uses.

Pagia may provide standardized licensing templates or contract management tools for convenience. However, unless expressly stated otherwise, the contractual relationship remains between the relevant licensing parties.

13.4 Royalty Administration

Where the Platform facilitates royalty collection, payment processing, revenue sharing, or rights administration, Pagia shall distribute funds in accordance with the applicable contractual arrangements, applicable fees, tax obligations, and Platform policies.

The administration of payments by Pagia does not create ownership rights in the licensed intellectual property.

14. ISBN and Rights Metadata

14.1 Publication Metadata

To improve discoverability, cataloguing, rights management, distribution, search functionality, and interoperability with publishing systems, Pagia may associate published works with bibliographic and rights metadata.

Such metadata may include titles, subtitles, authors, contributors, publishers, publication dates, edition numbers, ISBNs, Digital Object Identifiers (DOIs), language information, territorial availability, pricing, categories, keywords, licensing information, and rights ownership details.

Users are responsible for ensuring the accuracy of information they provide.

14.2 ISBN Administration

Where Pagia assigns, manages, or facilitates the allocation of ISBNs, such assignments are intended solely to identify specific editions of published works in accordance with applicable ISBN standards.

An ISBN does not constitute evidence of copyright ownership, nor does it create, transfer, or extinguish intellectual property rights.

The ownership of copyright remains governed by applicable law and contractual arrangements independent of ISBN allocation.

Pagia reserves the right to correct metadata associated with ISBN records where necessary to maintain catalog integrity or comply with international bibliographic standards.

14.3 Rights Metadata Integrity

Users shall not knowingly submit false ownership information, fraudulent contributor records, misleading publishing details, fabricated licensing information, or inaccurate rights metadata.

Where materially inaccurate metadata is identified, Pagia may suspend publication, request corrections, restrict marketplace activities, or take other appropriate action to preserve the integrity of the Platform.

15. Copyright Protection Technologies

15.1 Protection Measures

Pagia may implement technological measures designed to reduce unauthorized copying, piracy, unlawful redistribution, and other forms of intellectual property abuse.

Such measures may include digital watermarking, access controls, download limitations, content fingerprinting, encryption, digital rights management technologies, usage analytics, authenticity verification systems, blockchain-based rights records, provenance tracking, AI-assisted infringement detection, or other commercially reasonable protection technologies.

The specific technologies used may evolve as industry standards and security practices develop.

15.2 Circumvention

Users shall not intentionally bypass, disable, interfere with, reverse engineer, remove, or otherwise circumvent technological protection measures implemented by Pagia or rights holders for the purpose of protecting copyrighted works.

Attempts to circumvent copyright protection technologies may result in suspension or termination of Platform access and may expose the User to civil or criminal liability under applicable law.

15.3 Monitoring and Detection

To protect creators and maintain marketplace integrity, Pagia may use automated systems and human review processes to identify suspected copyright infringement, duplicate publications, unauthorized reproductions, fraudulent listings, manipulated metadata, or other activities inconsistent with this Policy.

Such monitoring shall be conducted in accordance with the Privacy Policy and applicable law.

Detection of suspected infringement does not constitute a final legal determination and may be subject to further investigation.

16. International Copyright Compliance

Pagia serves creators and rights holders across multiple jurisdictions and endeavors to operate in accordance with internationally recognized copyright principles.

The Platform seeks to respect obligations arising under applicable international treaties and national legislation, including the Berne Convention for the Protection of Literary and Artistic Works, the WIPO Copyright Treaty, the TRIPS Agreement, the Nigeria Copyright Act, the Digital Millennium Copyright Act where applicable, and other relevant intellectual property laws.

Because copyright laws differ between jurisdictions, certain rights, exceptions, limitations, moral rights, and enforcement procedures may vary depending upon the applicable legal framework.

Users remain responsible for ensuring that their activities comply with the copyright laws applicable to their jurisdiction and the jurisdictions in which their works are distributed or exploited.

Where conflicts arise between this Policy and mandatory provisions of applicable law, the applicable law shall prevail to the extent of the inconsistency.

17. Limitation of Pagia's Responsibility

Pagia provides publishing, marketplace, licensing, payment, and technology infrastructure but does not independently verify the ownership of every work uploaded to the Platform.

Accordingly, Pagia cannot guarantee that every publication, listing, licensing offer, or rights representation made by Users is accurate, complete, or lawful.

Except where required by applicable law, Pagia shall not be liable for disputes concerning authorship, ownership, contractual rights, succession, licensing authority, royalty entitlement, or other intellectual property matters arising between Users or third parties.

Nothing in this Policy shall be interpreted as requiring Pagia to proactively monitor every item of User Content for potential infringement.

However, Pagia reserves the right to investigate credible reports of infringement, preserve relevant evidence, implement temporary protective measures, cooperate with competent authorities, and enforce this Policy where appropriate.

18. Changes to this Policy

Pagia may amend this Copyright and Intellectual Property Policy from time to time to reflect changes in applicable law, international copyright standards, Platform functionality, technological developments, business operations, or industry best practices.

Where changes materially affect Users' rights or obligations, Pagia will provide reasonable notice through the Platform or by other appropriate means where required by applicable law.

The revised version shall become effective on the date specified at the beginning of the updated Policy.

Continued use of the Platform after the effective date constitutes acceptance of the revised Policy, except where applicable law requires additional consent.
